GENERAL TERMS AND CONDITIONS
The present general terms and conditions (“GTC”) apply to all orders placed and contracts concluded via the online shop of “Miiko” (“Order”).
“Miiko” reserves the right to change the terms and conditions. In each case the version of the terms and conditions valid at the time of the order is decisive, which cannot be changed unilaterally for this order.
The offer is aimed at clients domiciled in Switzerland and Liechtenstein. Deliveries are only made to addresses in Switzerland and Liechtenstein.
The offer is valid as long as it is visible in the online shop and/or stocks last. Price and assortment changes are possible at any time.
The images shown in advertisements, brochures, in the online shop etc. are for illustration purposes and are not binding.
The specific information on the product in the detailed product description on www.miiko.com is decisive.
The prices are in Swiss Francs (CHF). The value added tax (VAT) is currently not charged.
The price in the online shop at the time of the order is decisive.
The minimum order values listed in the online shop apply.
Ordered additional services with costs, such as delivery, are listed separately in the shopping cart and on the invoice.
The presentation of the products in the online shop of “Miiko” is not a legally binding request, but a non-binding online catalogue or a non-binding request to the customers to order the product in the online shop.
An order is considered as an offer to “Miiko” online shop to conclude a contract.
After transmission of the order the customer automatically receives a confirmation of receipt, which documents that the order has been received by “Miiko”. The customer can only add to or cancel the order until it is processed by our logistics department. If an order is supplemented, the original order is used as the basis for calculation, but possible special offers and discounts at the time of the supplement are not taken into account.
“Miiko” is free to refuse orders in whole or in part without giving reasons. In this case the customer will be informed and any payments already made will be refunded.
Further claims are excluded, in particular there will be no forwarding of products that are not available. Temporarily unavailable products cannot be reserved.
5. Conclusion of Contract
A contract is only concluded when the order is processed within the logistics of “Miiko”. By clicking on the order confirmation as well as the acceptance of the general terms and conditions and the indicated prices, a legally valid request of the customer is created. As soon as the order has been prepared for dispatch in the logistics department, the customer receives an order and acceptance confirmation by e-mail.
6. Performance of delivery
The delivery address of the customer must be in Switzerland and Liechtenstein.
“Miiko” endeavors to send deliverable items within 24 hours after receipt of payment by the Swiss Postal Service (“Post”).
PostPac is usually delivered by Swiss Post within 1-3 working days, if in stock (Monday-Friday).
The available delivery time ranges are shown in the online shop and can be selected by the customers for the respective order. It is not possible to determine an exact delivery time within the delivery time span. Deviations of a certain delivery date are possible, whereby any claims for damages as well as further claims of the customers are excluded.
On Sundays and official national or cantonal holidays, orders are neither processed nor deliveries made.
Delivery costs and place of performance
The delivery costs communicated in the online shop apply. The delivery costs are listed as an additional item in the shopping cart and on the invoice.
The service of “Miiko” is a fate debt, which is fulfilled with the delivery of the ordered goods to the transport company (usually the post office). The risk of accidental deterioration or loss of the ordered goods is transferred to the customer with the dispatch of the order. “Miiko” is not liable for errors of the used transport company. If production defects occur in the purchased goods within 24 months of the invoice date, the goods will be replaced free of charge. A guarantee is excluded if the goods show obvious defects caused by the customer. (These can be improper handling, natural wear and tear or influences for which the seller is not responsible).
8. Notification of defects
After receipt of the goods, the customer must immediately check them for defects and condition. If products are delivered with obvious damage to the packaging or the contents or with a deviation from the order, the customer must notify the seller of this, without prejudice to his or her right to claim for defects, within 3 working days at the latest by e-mail to email@example.com. Failure to do so will invalidate the warranty for these defects and the products will be deemed approved by the customer.
After the 3 day period, only hidden defects can be claimed, which must be reported to “Miiko” customer service immediately after discovery.
A return must first be confirmed by “Miiko”. No returns will be accepted between the customer and “Miiko” without prior agreement.
“Miiko” reserves the right to demand proof of the defect. If an obvious damage is discovered, it should be sent as evidence to firstname.lastname@example.org by image file.
In case of return of damaged or wrongly delivered goods, the shipping costs will only be refunded after consultation.
The amount paid by the customer for the defective goods will be credited to the customer. Refunds will be made after receipt and inspection of the returned goods using the same means of payment used for the purchase.
Instead of a financial refund and if requested and accepted by the customer, the defective goods can be replaced with an equivalent item whenever possible.
9. Payment options
Payments must be made in Swiss francs.

As means of payment Paypal, credit card (Visa, Mastercard, American Express) are accepted. If you pay by credit card, the amount will be debited after the order has been processed within the logistics process at www.miiko.com.
Refunds, credits, balances
If the customer is entitled to refunds or other credits, these will be credited to the customer using the same means of payment used for the purchase.
The homepage layout, the graphics, logos and pictures used, as well as all contributions are protected by copyright. Printouts are only permitted for private use. Any other duplication or use is not permitted without the author’s express consent. The company reserves all rights.
11. Applicable law and place of juristiction
The legal relationship between “Miiko” and the customer is subject to Swiss substantive law.
The place of jurisdiction is Meilen or the location of the customer’s registered domicile.
